Show 1. TRANSLATION Chapter 9 - Regulations of Article - #27 of THE CONSTITUTIONAL LAW ON THE EXPLOITATION AND BENEFICIATION OF MINERAL RESOURCES SPECIAL CONCESSIONS IN THE NATIONAL RESERVES. Article - 76 - Special Concessions for the exploitation of minerals in the National Reserves will be granted in accordance with the laws applicable to mining concessions in the Regulation, to Mexicans or to companies organized according to mexican laws, which provide that a series of shares (stock issue) representing 66% of the Capital Shares, at least can be subscribed only by mexican nationals, and cannot be transferred to foreigners. Special Concessions for the exploitation of atomic energy resources, or for materials specifically used in the construction _of nuclear reactors will not be granted._ Article - 77 - The applications for Special Concessions to exploit national re-serves will be accompanied by a program of work and investment required to exploit the resources covered by the application proof of the financial solvency and technical capacity of the applicant to _carry out the program will be required._ Article - 78 - The special Concessions referred to in this chapter, grant their holders all of the rights and obligations of the ordinary mining concessions, beside those established in this chapter and those which may be established in each contract or may be "title " _to a concession._ Article - 79 - The Secretary of the National Patrimony will call a meeting under the conditions and terms established by the Regulations in order to _grant the Concession to which this chapter refers._ Article - 80 - When an interested party desires to exploit under special concession, mineral resources considered to be in The National Reserves (As defined in part 2, Art. 71) (Substances exxential for the industrial development of the country). He will request the Secretary of the National Patrimony to hold a hearing and the full text of the app-lication will be posted on the official bulletin board in the corres-ponding Mining Agency Office. An abstract of the application will be published in a Mexico, D. R. Daily paper of Major circulation. After a period of sixty days during which oppositions will be received and considered a hearing will be held, according to the regulations of this Law. Under competetive conditions the Concession will be _awarded to the sucessful applicant._ Article - 81 - In no case will a special concession be granted within a national reserve without a sufficient bond to guarantee the performance of the obligations, work and investment specified in the Contract or title to the Concession Failure to comply with any of the conditions specified in the title to the Special Concession will cancel the _Concession and forfeit the bond.__ Article - 82 - The Concessionaires who exploit national mineral, reserves are obligated to pay to the "comision de Fomento Minero, the percentage specified in each contract on the net value of production realized. These sums (royalties) will be credited to the Fomento Minero for its own use. Payments may be made in currency or in product of corresponding value. Article 83 - Special Concessions for the exploitation of National Reserves and and the rights which they convey can be transferred in part or entirely, only by authorization of the secretary of National Patrimony to persons for Companies who are in accordance with this law entitled to obtain this type of Concession directly. The Secretary of National Patrimony may at his descreation cancel or deny any such authorization. |
