POOLE ASSOCIATE 24th 1944 ATTORNEY TELEPHONE GROEN RANDOLPH 4848 LEAVE Mr. Gordon M. Baxter, SCHOLEFIELD, WELLS & BAXTER 1219 First Security Bank Building, Ogden, Dear Utah. Gordon: This will confirm the tions that I have had with you to advise you that we now have for February 15th for a meeting various telephone conversain the last few days, and a tentative appointment set with the Ste Louis Board. Major Thielecke said that he had already sent the name of the J.M. & M.S. Browning Company with others to Washington for confirmation of reassignment to their Board. He said were justified in assuming that the Company would be renegotiated for the year 1943 by their Board, and that it was entirely proper for us to initiate the proceedings and come down with facts and figures at the time agreed upon. In the meantime, I think it would be weil to make the voluntary adjustment of the royalty on the 37 mm. guns as discussed, and to do so by advising Colt's that :the royalties will be $50.00 instead of $60.00 on all 37 mm. guns delivered after December 31, 1943. I1 think this should be done as soon as possible, so that we can tell the St. Louis Board that this voluntary adjustment has been made in order to bring the 37 mm. royalty in alignment with the royalty done on machine guns. I do not respect think, to the with however, that anything should be more complex question involved in the sub-License to the Government requiring to buy Colt's machine gun capacity. Furthermore, 1 do as yet with respect to the have no idea what position not think we the Government * should do anything May 1lOth expiration date, as we Colt!s will take. Our attitude, of course, is that royalty should continue, and any from this established relationship should come as a to us and be delat with only I am leaving for proximately two weeks. I the can when East and as and w reached it comes up. variation surprise |
