Dear Mr. Bennetts: Both Sears and Ward will list our Gun Cases in their Fall Catalogues. The Cases will not be shown on the same page with our gun but a reference will be made on the gun page to the page on which these cases will be described and illustrated, Upon returning to St. Louis and realizing the attitude of Montgomery, Ward & Company particularly, I began to speculate regarding the case situation. They have agreed to list these cases at our regular price and we are going to give them 25% off this list -- the same as the guns. If the case business should develop into a profitable volume, there would be nothing under the present arrangement that would prohibit them from buying a few cases from us and obtaining their major requirements from their luggage manufacturer and thus they would realize the entire profit, to say nothing of the probability of them cheapening the case though selling it as a genuine Browning product. I accordingly took the matter up with Ely-Walker here who make our cases. We have given the matter considerable thought and they are inclined to fee] that my fears will likely be confirmed in view of their past experience with both of these houses. in order to get around the situation, this plan hes been decided upon: The gun case has been shown to HlyWalker's regular patent attorney and it is his opinion that he can likely get a patent on the inside design of the case. At least he will apply for a patent on the design as well as the structure of the case, This will permit us to promptly start stamping the cases, "Patent Applied For", Our present gun case is a product of the come bined thinking of both Bly-Walker's trunk factory and ourselves, though Ely-Walker, of course, make no claim to any interest in 1t whatever; in fact, they have none and our relationship with them1s most pleasant and satisfactory in every wey.
