Dear Mr. Russells: I have your letter of January 20th, the possibility of a change in the rates of duty provided for in the foreign trade agreement with particulerly whether such a change might be made inquiring as on shotguns, Belgium, and by executive to as ordere As you probably kmow, the law authorizing the President to enter into trade agreements with foreign countries expressly prohibits the application of the flexible tariff provision (section 336 of the Tariff Act of 1930) to any article which is the subject of such an agreement. Consequently, neither the Tariff Commission nor the President may proceed under the flexible tariff provision to make any change in the rates of duty on shotguns, as now provided for in the foreign trade agreement with Belgium.
