It may be thet some further explanation of the letter dated July 24, 1944, to Colonel HNerrstron < in ordere A thorough study of the contract of December 19, 1938, and prior contracts was made in Chicago in an effort to ascertain just what prompted Colonel Horrstrom!s request for this informations After reading the statement of the attorney sent to the Patent Section in Washington by Mre Hume on Jume 2, 1944, it would appear that the question might be considered as a natural one inasmuch as reference is made to this agreement in several places. It was upon sefe the consensus of ground in assuming thet opinion in this agreement represented the at the time it was entered intoe royalty applicable to the caliber time of payment the the attorneys in amounts of which were designated Chicago that we were as royalty very best judgment of parties to the contract In other words, %6.00 was desirnated as 50 gun of a total payment in effect at that $35.00. An amount of $25.00 was designated as royalty out of a total in effect of $75.00 at the time the contract was entered intose Even . though subsequent reductions have been made in this royalty to $5.00 for the caliber 30 gun and $10.00 for the caliber 50 gum, it is considered entirely reasonable that the same proportions apply to the los ser fifurese t is theory thet felt on that May 10, Colonel 1944, Nerrstrom that is portion asking for this ascribed to roy ralty aguante upon the should eliminated from the paynente, 6otherwise the payment for services is areca by 63.535. Washington will, therefore, probably ask that the total payments after May 10, 1944, should be reduced to $6.66 per gune We, of sourse, are not in a position to know exactly what Huxley particularly seems whet thoy are after. to think they are thinking in Washington, that next é the opinion above but Mre expressed is |
