Subject: Dear BROWNING ARMS TRADE MARK MLE. : Enclosed is a copy you can see we are country. of lettersrecently sent to Mr, Nebeker, from which trying to get action on boot leg shipments to this Poe We have had a great deal of difficulty getting first hand legal advice on trade marks. We at first started out to have an impre ssion of our name ,made on all automatic shot guns ,which we expected to trade mark, but after fooling around for a year or more, decided that we knew so little about such matters, that we had better move Slowly. Inasmuch as steel impressions are hard to make and we would not like to have to change the mark when once we started, for vario us reasons, we decided that we would trade mark the design which was alrea dy on the butt plates of the guns, We are in receipt of advice from Mr. Nebekerts office that the registration of this trade mark is about complete and it is our idea to then proceed to stop such shipments through the Customs house if possible, and no doubt we will learn something at least. The objection to the trade mark of the butt plate desigh is that the butt Plate may be removed and another butt plate attached, although there seems to be a decision that collectors at ports of entry are not allowed to let importers make such a change, The point necessary which the shot guns we are getting at is that sooner or laterwe belie ve it will be for us to figure out a design for a suitable trade mark and one factory will be willing to stamp in the metal on all automatic manufactured, whether purchased by us or others, We are enclosing herewith copy of statement on the law, which may behelpful to yous A copy of this statement was sent to Mr. Nebeker when we were first endeavoring to get a trade mark and it was his opinion that sect ion oc6 Tariff Act of 1928 was suitable to our purpose, MAB=T Fine.
