Co., oir:- Your letter to Mr. Nebeker with assignment of trade mark from Browning Brothers Company to Browning Arms Company has been received. I will have the assignment recorded as soon as the certifieate has issued, which should be October JOth. After a trade mark has been allowed, the word "allowed" being a technical word meaning that the examiner has found no cause why the trade mark should not be registered, and no party has filed then it takes three opposition to its registration, or four weeks before actual registration becomes effective, as the mark is published in the "Official Gazette” on the day registration becomes ertfective and it takes some time to set up the type, etc., and to prepare the certificate. Therefore, registration does not become effective until a date three to four weeks after the application has been allowed. This explains why we were unable to take action on the matter you wired us about, and also why it will be necessary to wait before recording the assignment. The application might have been asSigned, but it would take mad-e and sent on about as long to have such an assignment here as it will take for the registration to so he completed, I will proceed Yours very Wize as indicated. truly, ous |
