D, C. | 3 Sub ject: Tradeemark, Nebeker: Your letter of March 26th was received, together enclosed application papers for trade-mark, The latter herewith, duly signed and acknowledged, with the sre enclosed In as much as the guns are being imported to this country under the name *Browning Brothers Company', we have inserted this name as the applicant. ‘ve have also inserted the name 'F, N.* as being one of the words disclaimed, except in the combination shown, we note what you say regarding the ownership of the letters ‘ry. Ne', but feel perfectly safe in proceeding as outlined. We are making application for the trade-mark, consisting of names and letters as shown by the combination only, which is imprinted in-the butt plate consisting of ‘Browning Automatic’ and 'P, N,? Under our contracts with the Fabrique Nationale, they are excluded from this territory and therefore, they would have no right to apply for such a trade-mark, it is our belief that they have not tradeemarked their name or initials in this country, either alone or in any combination, Also there would be no trouble about getting consent from the vabrique for the trade«mark proposed if it should be necessary, but we don't believe granted, should that it is, “® expect to notify the Fabrique Nationale what we have done and to have them ehange the labels which they are sticking to the gun packages and vhereby affix our trade-mark, under which will be printed the name ‘trade=mark', We understand something of this order is necessary as notification to the public that a tradeemark is registered, Assuming the application is we look forward to making use of the collectors at the ports of entry for the che purpose of withholding any importations of guns bearing our trade-mark, and we therefore, call your attention to Article 477 of Custom s Regulations 1925, which we quote in part: | “Such application should state the names of the ports of entry in which the tradeenome is to be recorded, Affidavits accompanying applications to record the trade-names of manufacturers or traders located in foreign countries should be acknowledged before an American consular officer," Also Article 478, Illegal Importations: |
