Sir:-~ I have your letter of March 30th and note that you desire us to proceed with the registration of the trade mark as indicated in your previous letter. I will, therefore, file the application as soon as I have had the drawing prepared and photostats made therefrom, and I will send you two copies of the photostat as you request. It seems advisable to omit a11 disclaimers from the original application, and to supply same by amendment when and if required by the Patent Office, the idea being to get as much of the mark protected as possible and disclaim- ing nothing unless With forced respect to to do so. the label you contemplate affixing to the gun package, it seems to me that this would properly be the subjeet of another application for registration, as all we are claiming in the present application is the design imprinted in the butt plate of the gun. I suggest that after you have used such labels in interstate commerce you apply for registration of the label as so used. It is not possible to register the label before it has been so used. Your letter indicates that you desire to proceed at once to notify infringers and customs officers as to your ownership of the mark, but so far as the latter are concerned, you will note that registration in the Patent Office tions, is a prerequisite. 1923). After such (See Art. 476, Customs Regularegistration has been secured, I am of the opinion that my office can handle the matter of registration in the Treasury Department without difficulty. A list of ports in contained in the Customs Regulations, which I sssume from your letter you are provided with. An examination of this list may show that it is not necessary to notify all ports.
