I was quite relieved when he said that the only difficulty would be to get an offer approved in an amount less than that shown in the Bureauts computation, even using our own figures as to sales and adjustments. Taking this statement, together with his statement yesterday. indicated that the Bureau may be considering a settlement substantially on the basis proposed. It is quite possible, however, that Mr. Hoyt may come back with the suggestion that he would approve a settlement on the basis of Mr. Eckstrand's computation, computing the tax at 1/10th, rather than 1/llth. When the Bureau realizes, too, that acceptance of this offer will mean a possible refund of the suit period greater than the deficiency in the post suit period, it may suggest an offer that would eliminate the refund and also the deficiency. I had thought at one time of making such an offer, but concluded finally to leave that as a possible future alternative. no I hope you will explain to Mr. Browning that there is certainty that the offer filed with the Department of |
