Martinez is out of town on vacation and cannot be reached by phone, his attorney, Jim Retallick, said Friday afternoon. Retallick insisted, however, that Martinez denies all allegations of any sort of misconduct: “T think they were hasty,” Retallick said of the city. “I think iti: was a rash decision to terminate him. I don’t believe they had just cause to > terminate him.” He said Martinez was supposed to be interviewed Monday by an outside counsel who is investigating “an allegation of some discrimination issues that Dean had raised,” in October. He said that as part of cooperating with that investigation, Martinez “did get some documents } from the city to use to amend his initial complaint, because if it was to be formally investigated he wanted it to be fully addressed, and the city chose to take the action it did.” As a result, Retallick said, he considers Martinez’s firing “retaliation for his initial complaint.” Retallick declined to discuss the specifics of the discrimination complaint. He would not say whether it involved Martinez directly or if Martinez was helping with a complaint involving someone else. Retallick said he has to look more closely into the ~ law to see what he can disclose about the case. “I anticipate, within the next few weeks, making a decision what documents we will disclose, and we will do so at the appropriate time,” he said.
