Show Ordinance 2012-03, vacating Combe Subdivision on 1700 South as part of a boundary adjustment which corrects an error on the original survey, was approved by the council on May 17, 2012. Mr. Combe has a new Mylar plan printed showing the correct lot lines for the 1st Amendment to the Combe Subdivision. Upon completion of the process the Recorder's Office records was updated to show the correction. Ordinance 2012-04, an ordinance prepared by the Weber County Animal Shelter Committee to assist animal control personnel by providing a uniform ordinance similar in all participating cities in Weber County. The ordinance was adopted unanimously on August 16, 2012. Ordinance 2012-05 reflects some amendments to the Comprehensive Storm Water so it will conform with existing laws of the state relating to the implementation of Phase II of the Federal Clean Water Act. It incorporates changes to the General Permit issued by the State to the City. The City Engineers, Jones and Associates, prepared the Ordinance. On September 20, 2012, the Council adopted the Ordinance unanimously. Ordinance 2012-06, relating to amendments to Chapter 13.26 for regulations applicable to more than one zone as it relates to fencing and metal roofs was discussed by the Council. The Planning Commission held a public hearing on September 18, 2012, to take public comment on the Ordinance, after which the Planning Commission gave its recommendation to approve this Ordinance relating to fencing amendments and deny as it relates to the setback of metal roof buildings. The fencing portion of the Ordinance adds: "No fence shall be topped with barb wire, razor wife, or similar device on lots used for residential purposes." The staff explained that such types of fence on residential properties are not appropriate. The metal roof amendment was proposed by Nathan Crowton, who requested that the side yard setback from metal roof buildings be amended from 8 feet to 6 feet. Trent Meyerhoffer stated that the Planning Commission had a concern about changing the law after it had been enforced for the past four to five years. The Planning Commission did not want to change it, recommending the setback remain at 8 feet. Mr. Crowton, petitioner, felt that 8 feet between a fence and a shed leaves too much space where transients can come, or weeds can grow. After discussion, the council voted on a motion to remove the section amending the set back for metal roof sheds so it will remain at 8 feet, and unanimously approved Ordinance 2012-06, as amended, on October 18, 2012. Ordinance 2012-07, concerns parking amendments. It will allow the city to regulate the parking of recreational vehicles and other equipment on city streets. It does not apply to private property. Ordinance 2012-07 was approved 4 to 1, with Councilman Delbert Hodson voting nay October 18, 2012. A public hearing was held on October 18, 2012, at the City Building, concerning the new proposed business license fees. The regular City Council Meeting was closed and a public hearing opened. The city opted to update the business license fee study to represent the current cost of administration and law enforcement services incurred by each business category. Zions Bank was retained by the city as consultant to conduct an independent review of the businesses and prepare the study along with the proposed business license fee increases. Mrs. Jeanette Harris from Zions Bank prepared the 2013 Business License Fee Study, and made a presentation of the proposed fee increases and the justification for the same. The last study was done 12 years ago, and law enforcement costs have increased significantly since that time, with a large increase coming in 2013. She discussed the base license fee and explained that the only disproportionate fee the city proposes is for law enforcement, which is based upon calls for service over and above the base level of service provided. She made recommendations regarding the proposed fees, a good landlord program and non-discrimination policy for rentals, and outlined a streamlined approval process. 3 |
