Show May 30, 2011 MARRIOTT-SLATERVILLE CITY EXECUTIVE ORDER 2011-01 DECLARATION OF LOCAL EMERGENCY - FLOOD DISASTER AN EXECUTIVE ORDER OF THE MAYOR DECLARING A LOCAL EMERGENCY WITHIN MARRIOTT-SLATERVILLE CITY, UTAH, BASED UPON IMMINENT AND ONGOING CITY-WIDE FLOODING ; IMPLEMENTING EMERGENCY POWERS; CALLING UPON MULTI- JURISDICTIONAL AND STATE AID; ANTICIPATING THE NEED FOR FEDERAL RESOURCES; SEVERABILITY; AND EFFECTIVENESS. WHEREAS, Marriott-Slaterville City ("City") is a municipal corporation duly existing under the laws of the state of Utah; WHEREAS, the City operates under the optional council-mayor form of government set forth in Utah Code Annotated("UCA") §10-3b-201 whereby the powers of government in the City are vested in two separate, independent, and equal branches of municipal government; WHEREAS, the Mayor may issue Executive Order in accordance with Marriott-Slaterville Municipal Code ("MSMC") §2.06.010, and as authorized by UCA §10-3-202; WHEREAS, in accordance with UCA § 63K-4-301, the Mayor is the chief executive officer and may declare a local emergency for the City; WHEREAS, the nature of this emergency is imminent and ongoing flooding resulting from climactic weather events, excessive precipitation, and excessive storm water run-off that has been ongoing since April 18, 2011, resulting in a flood disaster within the City and other jurisdictions; WHEREAS, the City is one of the lowest points in Weber County and is severely impacted by the flood waters of the Ogden River, Weber River, Mill Creek, Four Mile Creek, Six Mile Creek, the Warren Canal, and other watercourses (natural or man-made); WHEREAS, regional reservoirs located within the Weber Basin are at or near capacity and the water discharged from reservoirs in the Weber Basin directly impacts the City posing an imminent and ongoing danger to public health, safety, and general welfare; WHEREAS, the climatic weather events of this spring have delayed the melting of the snowpack at higher elevations with is anticipated to result in further excessive run-off that will continue to impact the watercourses in the City causing additional flooding; WHEREAS, the river banks along the Weber River and Warren Canal within the City have been compromised, breached, and/or damaged by high-water flow; WHEREAS, sandbagging, ongoing flood control measures, and numerous emergency resources have been expended within the City since on or about April 19, 2011, to protect the general public, and to protect many local businesses and families; 70 |
