Show Marriott-Slaterville City Page 2 Executive Order 2011-01 - Declaration of Local Emergency WHEREAS, based upon continued precipitation, soils in the City has reached saturation and cannot absorb additional storm water, and groundwater in the City is at an all-time high as is evident by standing water visibly seen on the ground throughout the City; WHEREAS, an undetermined amount of precipitation may yet fall, and the City is in an ongoing flood disaster with portions of the FEMA flood plain already under water; WHEREAS, the City does not have the resources or jurisdictional authority to continue to implement all of the emergency strategies necessary to respond to this flood disaster; NOW, THEREFORE, in accordance with UCA §63K-4-301, et seq., the Mayor of Marriott- Slaterville City hereby Orders and Declares as follows: Section 1: Nature, scope, and effect of the local emergency. 1. Nature and scope. The nature of this local emergency is an ongoing flood disaster that has been occurring since on or about April 18, 2011, and encompassed the entire City based upon the conditions and findings set forth in the recital clauses above. 2. Effect. This Executive Order: a. Constitutes the official recognition that a disaster situation exists within the City. b. Provides legal basis for requesting and obtaining state or federal disaster assistance. c. Activates the applicable response and recovery aspects of any and all applicable local disaster and Emergency Operations Plans. d. Authorizes the furnishing of aid and assistance in relation to this disaster. Section 2: Executive emergency powers. Based upon this flood disaster, the executive emergency powers specified in state law and in MSMC § 2.06.080 are hereby authorized and may be implemented by the Mayor as needed to appropriately respond to this flood disaster. Section 3: Weber County. The City incorporates herein and reiterates the assistance and statements made and requested by Weber County in its "Declaration of a Local Emergency" dated May 24, 2011. Section 4: Call for aid and assistance. The City calls upon multi-jurisdictional, state, and federal aid and assistance to the City as directed and/or approved by the Mayor or his designee. The City calls upon state and federal aid to help with the reimbursement of emergency expenses incurred since April 18, 2011, relating to this flood disaster. Section 5: Effective date and duration. This Order is effective upon the first date indicated below and is effective for thirty (30) day therefrom, unless extended by the City Council. BY ORDER of the Mayor this 30th day of May, 2011.
