Another Problem in Zoning in 1972 Commission Favors Slaterville Rezone The Weber County Planning Commission has said it favors rezoning 1.66 acres at 1427 W. 400 N., Slaterville, for two housing lots if the petitioner and officials of the Perry Irrigation Co. can agree on an easement to protect a ditch. Mr. and Mrs. Charles McGraw want to build on 20,000-square-foot lots in an area now zoned agriculture A-l that permits a house on each one acre. Ronald O. Smout, a property owner across from the McGraw's site, said a water ditch traverses the McGraw property. He questioned if there was 100 feet frontage required by the zoning ordinance. Smout said he and others had legal access to the ditch by right of use the past 40 years. The ditch in question is in addition to the Perry Irrigation Co. canal. Smout suggested a 150-frontage be required for the homebuilders. Keith Butler of the Slaterville Planning Committee spoke of his concerns for protecting the irrigation ditch and the Willard Bay Canal that has six-foot banks. John Albert, speaking for the McGraws, said the property meets the RE-20 zone requirements in the petition. Mrs. McGraws said her family had inherited the ditch eight years ago and she shouldn't be penalized to provide water to others. "They're able to cover the ditch," she told the commission. "There's an elementary school nearby and people using the ditch should cover it." Commissioner Robert Wangsgard said he doesn't think the responsibility for covering the ditch can be placed upon the Perry Irrigation Co., that, he said, has a right to use the ditch that you'd probably have to cover." 37a
