Show PLANNING COMMISSION June 12, 1990 Page Three 4c. RY-KY Subdivision Final Approval Staff indicated this subdivision received preliminary approval at the last meeting. The subdivider is Gage Froerer and the subdivision is located at 1000 N. 7800 E. in the South Fork Area. Staff recommends final approval subject to the following conditions: 1. Lot area and addresses to be added to plat 2. Subdivision boundary problem to be solved 3. All owners to sign plat 4. All owners to sign Service Area Agreements 5. Subdivision - Fees $200.00 to be paid Staff indicated that the South Fork Planning Committee has been notified and they are not in opposition to this proposal. MOTION: Commissioner Fuller moved to recommend to the County Commissioners that Final Approval be given to RY-KY Subdivision subject to the Staff comments as stated above. The motion was seconded by Commissioner Widdison and voting was unanimous. Commissioner Fuller asked where this subdivision will be receiving primary water and staff replied that the primary water source will be from the drilling of wells. 4b. Marriott Business Park -Relief from fencing requirements Staff indicated that the Christiansen Brothers are asking for relief from the fencing requirements for the Marriott Business Park just west of I-15 on the north side of 12th Street. At the last meeting final approval was given to two lots of the subdivision. The subdivision ordinance requires that if the water flows over 5 second feet in an irrigation canal, it must be fenced with a 5 foot non-climable fence. The primary reason this is required is to protect the County in approving subdivisions in residential areas. Staff recommends that the Planning Commission Board consider granting the relief from the fencing requirement because there may be mitigating circumstances, but the ordinance does not differentiate between residential and commercial zones. Mr. Simon Christiansen stated that the canal as it transverses along 12th Street will be put into a concrete culvert. He indicated that the closest residence to the canal is about 1,000 feet. They would like to be relieved from the fencing requirement because the right of way is also being used for other utilities such as power, telephone access, etc. and there would be a problem of who would control the fence or who would have the key. Commissioner Fuller indicated that one of the purposes of the fence is when industrialization occurs there is usually a considerable amount of garbage. The fence can prevent this from going into the canal and being used for sewer. 419 |
