Show WEBER COUNTY PLANNING COMMISSION August 28, 1990 Page Nine Mark DeCaria indicated that one area has been tested in the court is reversion back to the prior zone. The courts are split in their opinions whereas some say it can't automatically revert back and some say you can't deprive the planning commission of the ability to make that decision because it's unconstitutional. Staff indicated that they will have the County Attorney's Office review the agreement and that rezoning by itself does not promote the health, safety, general welfare, etc. as spelled out in State Law. If there is no development, then there is no purpose obtained in terms of State Law. VOTE ON MOTION: Motion passed by a 5-1 vote, with Commissioners Gibson, Hancock, Thompsen, Widdison and Thompson voting aye and Commissioner Coleman voting no. 15. Proposed 1991 Budget Draft for Review MOTION: Commissioner Coleman moved to go into an Executive Session. The motion was seconded by Commissioner Hancock and voting was unanimous. Discussion followed privately without the staff in attendance. The Chairman ruled the regular planning commission meeting was now in session. MOTION: Commissioner Coleman moved to have the Planning Commission support the proposed 1991 Budget as prepared by the staff with the recommendation that the Chairman and Vice Chairman attend the Budget meeting with the County Commission to recommend that an additional staff person be hired at the salary of $14,500.00 to fill a Planner II position.
