Show PLANNING COMMISSION August 28, 1990 Page Three Randy Phipps, member of the Marriott Planning Committee, indicated that on the map it may look like they do not have a vast amount of property designated as M-1, but approximately 50% is designated as M-1. Commissioner Thompsen indicated that when this property was sold some years to Christensen Brothers, when they bought it with the intent of building a mall there and so it was zoned CP-3 to do so and the mall was never built. For twenty years the property has just been sitting there. Since that time, there have been 10-12 nice homes built along 700 S. on both sides of the street ranging in price from $75,000 to $150,000. They built these homes in good faith thinking it would be okay to do so. He is concerned that if this zoning is changed to M-1, which the community is opposed to, it would go against the good faith of the people who have built and are building. When the realtor presented the plan for this site he indicated a road going back through the property. Therefore, he does not see any reason why a commercial area would not be successful. Staff indicated that the argument has been brought up about how much area in the Marriott area as being designated M-1. They believe it is a situation of circumstance because of the desirability of some of the property. There are some major streets which access the sites. In regards to the new homes, the home on the south side knew what the proposal was but they still decided to build their home there. Carl Slater indicated that there is already property which has freeway exposure and is already designated M-1. There is a subdivision on the south side of 1200 W. which is probably only about 50% occupied that also has this exposure. They desire to have some control over this property and to have some say about what is developed in their area. James Ito lives on 700 S. directly across the intersection where high density housing and manufacturing is proposed and in 1981 when he built his house he did not know of these plans. He indicated that what Mr. Slater is saying that when the need arises on this site for a manufacturing use that they could review it at that time and have some control of what is developed. They would like to have some say of how they live. Commissioner Coleman indicated that we are not zoning the site M-1 but are designating it for if and when in the future the need arises. Randy Phipps indicated that when a map is designated as a particular zone it opens it up to the uses allowed. They feel by designating this as M-1 it would open the site up to more of the same type of problems they already have in their community. Staff indicated that if a zoning petition comes in the future to rezone this site to M-1 and it is not designated on the masterplan, the whole procedure will have to be followed again to review and possibly revise the master plan. Discussion followed concerning the development agreement which will be discussed later in the meeting. MOTION: Commissioner Thompsen moved to accept the Marriott/Slaterville Land Use Masterplan as proposed with the exception of the piece which is designated M-1 North of 1200 S., west of the freeway and east of 1900 W. and that said piece have a commercial designation. The motion was seconded by Commissioner Widdison and voting was unanimous, with Commissioners Coleman, Fuller, Gibson, Hancock, Thompsen, Widdison and Thompson voting aye. The Commissioners decided to hear Item #7 at this time 7. Zoning Site Plan, Zoning Compact - 400 N. to Farr West City Limits. I-15 east to Willard Canal -Frank Blair. Staff indicated that at the July 31, 1990 meeting a motion was made to approve rezoning 93 acres for Mr. Frank Blair. The motion was made subject to site plan review and commitments that Mr. Blair has made to the local planning committee and subject to the development agreement which he has voluntarily agreed to follow or enter into. Staff had a meeting with Mr. Blair in which the motion reviewed. The documentation Mr. Blair had to submit to the staff was the land design for his industrial park, the zoning description for the proposed rezoning, a letter of commitment from Bona Vista Water and a letter of commitment from the sewer district that these services would be provided as well as a list of possible uses. Mr. Blair has provided the documentation of commitment for the culinary water service as well as the Central Weber Sewer District's letter which was received just prior to the meeting. He also provided a list of possible uses for the site. Staff has not received the drawing of how he proposes to develop the industrial park and the road pattern system. 441 |
