Show 3. Determine the initial terms of the mayor and council (the mayor and approx one-half are elected to serve an initial term of no less than one year, that allows their successors to serve a full four-year term that coincides with election at the 1999 municipal election. The remaining council members are elected to serve an initial term of no less than one year, that allows their successors to serve a full four-year term that coincides with election at the 2001 municipal election. 4. Hold a public hearing within the proposed city regarding the above items (1,2,3), which public hearing is advertised once a week for 2 consecutive weeks before the hearing. The last publication shall be at least 3 days before the public hearing. (Publications could run once during the week of August 10, and on August 17. The actual hearing could be held on Wednesday, August 20. The Commission would be notified of the results by the following Monday, August 31. 10-2-115 Official publication of above info by County Clerk, declaration of candidacy By September 20 - County Clerk publishes once a week for 2 consec weeks: (Publication dates of Sept. 5 and Sept 8) 1. Info about deadline for filing declaration of candidacy for mayor or council (Filing deadline of September 18, 1998) 10-2-116 Election of mayor and council The Primary election (if needed) or the final election would be held November 3, 1998 If the Primary is held November 3, 1998, the final election would be February 2, 1999. 10-2-117 Within 10 days of the canvass of the final election, County Clerk sends notice to Lt. Governor of the name and position of each officer elected and their term. 10-2-119 At any time after the canvass of the final election, articles of incorporation can be filed with the Lt. Governor by the mayor-elect. A city if incorporated upon the Lt. Governor's certification of the articles of incorporation. 10-2-120 As an alternative to filing articles of incorporation, the mayor-elect can file a verified notice of intention to file the articles of incorporation with the Lt. Governor. After the Lt. Gov. certifies the notice, one copy is delivered to the County Cleric, one is returned to the mayor-elect. Upon receipt of that certified copy from the Lt. Gov by the mayor-elect, and until the future city becomes legally incorporated, the officer of the future city have the authority to carry out those duties as outlined in 10-2-120 (3). 118 |
