Show WEBER COUNTY PLANNING COMMISSION August 28, 1990 Page Four Frank Blair indicated that he presented his design as it was proposed some time ago and stated he amended the roads based on the concerns of the Slaterville residents. He indicated that at the last meeting when he stated that he would voluntarily sign the development agreement, he thought it was the Urban Service Area Agreement. He has since read and reviewed the proposed Development Agreement with his lawyer and indicated the agreement has some irregularities that give them concern. They also felt it should be approved before he is required to sign it. Staff indicated that the Development Agreement will be an agreement between a petitioner who wants rezoning and the County. The County is saying they are not interested in rezoning without the results of what will be done because the County does not benefit. If the County is prepared to grant the rezoning, they want to see that the things that are promised are carried out within a certain time frame. If there is no performance, the Planning Commission can take steps to revert the zoning back to the former zone. The Staff feel that before the County Commission grants Final Approval the Development Agreement should be in place so that Mr. Blair knows what the County expects of him and so that the County knows what to expect of Mr. Blair in such a large development. Commissioner Fuller indicated that he tends to see the County's interest in providing for something to happen, but he does not know what the time frame should be. Staff indicated that the time frame is to be negotiated by the County Commission at a later date. Commissioner Hancock indicated that he understands in the Development Agreement the zoning may revert back but does not do so automatically. He believes the word "shall" should be changed to "may". He undderstands that that at the last meeting, Mark DeCaria indicated that Mr. Blair could contract with the planning staff to use the ideas in the Zoning Development Agreement, it wasn't necessarily that he was signing an agreement as if it has already have been approved. Staff indicated that it is suggested that as part of the concept plan be a rough phasing plan of the 80 Acres and include where is the area they intend to develop first--what they consider to be the logical first step because they have to bring all of the services to the site. This can be outlined and it can be addressed by means of the agreement and not commitment on the whole 80 Acres. Mr. Blair indicated that there is no way to phase this site for an industrial park and have it be realistic. Staff indicated that the development agreement can be refined specifically for Mr. Blair. Mark DeCaria indicated that development agreements are negotiable with the developer and the County. Chairman Thompson stated that this item should be considered by the County Commission at the earliest opportunity providing that Mr. Blair submits his concept plan. He has already indicated that he is willing to negotiate this development agreement. The Commissioners decided to hear Items #5 and #6 together at this time. 5. Z.P. 9-90 by Brad Skinner to amend the CR-1 Zone to allow a Real Estate Office as a Conditional Use (Chapter 22 C P. 91 Z.O.). 6. Z.P. 10-90 by Brad Skinner to rezone property at 3700 N. Wolf Creek Drive (See Map 6 next sheet) to CR-1 (Chapter 9B. P. 41 Z.O.) for Real Estate Office. Staff indicated that on the second application where he addresses the actual zoning, the application states the following: to rezone the property from FR-3 to CR-1 for rental offices, living quarters, garages and restaurant. There is a discrepancy between the two applications of what is really desired. Commissioner Thompsen asked if the letter went out to the Eden Planning Committee of what is proposed. Staff indicated that the letters were not mailed. Brad Skinner indicated that there is actually three pieces of property on the site which are owned separately. They are proposing to buy the two acre piece and that it be rezoned to CR-1. They have found that there is quite a need in the area for rental offices, etc. They propose to put in boat, snowmobile and other equipment rentals to go along with their rental offices. 442 |
