Utah 84401 (801) 621-8710 (801) 621-8731 Fax August 15, 1997 ATTN: Diane Hirschi, City Recorder Farr West City 2090 North 2000 West Farr West, UT 84404 RE: Void Annexation Petition Filed By Mr. Blair Dear Diane: Please note that it is my legal opinion that the annexation petition which was refiled by Mr. Frank S. Blair is void under the new laws known as H.B. 363 and H.B. 2001. I have enclosed a copy of Mr. Blair's petition and copies of the relevant pages of the newest statute, H.B. 2001. Mr. Blair has not complied with the highlighted (and other) provisions of the new law, including but not limited to providing the required notice and other procedural requirements, etc. Please note that the Marriott-Slaterville Request for Feasibility Study (copy enclosed), which contains all of the area proposed to be annexed by Mr. Blair's annexation petition, was filed on June 24, 1997 and the Request was certified on or about August 7, 1997. No new annexation petition can be filed on or after June 24, 1997. If Mr. Blair were to file his petition again (for the third time) to correct the aforementioned problems, this filing would be counted as a newly filed petition and would also be void because no new petition may be filed while a Feasibility Study is pending. It is also my legal opinion that Resolution No. 97-02 dated June 5, 1997, is void because it likewise does not comply with the new law, but rather, cites the old law regarding "policy declaration," etc. Please have your city attorney respond to this letter and ask the Mayor if it would be appropriate to put discussion regarding this item on the city council agenda. Moreover, I would like to know what point the process of Mr. Blair's annexation is currently at. It is my understanding that there is no need to file a protest to the proposed annexation since it is void.
