GIVEN A PASSIVE BOARD OF DIRECTORS AND A PARTICIPATORY STYLE OF MANAGEMENT, THE COURT FINDS HERE THE CLASSIC CASE OF "THE INMATES RUNNING THE INSTITUTION." THEREFORE, THE COURT VACATES THE JUDGMENT ON CHARGES III THROUGH V AND FINDS FOR THE DEFENDANT. LENIENCY IN IMPOSING JUDGMENT IS FURTHER INDICATED BY THE QUALITY AND CHARACTER OF SOME OF THE WITNESSES CALLED. THE MOST CONVINCING WITNESS WAS BETTY ANDERSON WHOSE KNOWLEDGE OF THE DEFENDANT WAS BOTH DAMNING AND DEVASTATING BUT A WIFE CANNOT BE CALLED UPON TO TESTIFY AGAINST HER HUSBAND HOWEVER EAGER SHE MAY BE TO DO SO. THE TESTIMONY OF THE WITNESS ARBUCKLE IS PERHAPS IMPEACHABLE BUT THE COURT CANNOT ACCEPT THE CONTENTION THAT IT SHOULD BE |
