Show 8/20/79 AS THE PRESIDING JUSTICE OF THE SAN MATEO COUNTY COURT OF APPEALS, I DELIVER HEREWITH THE OPINION FOR A UNANIMOUS COURT. THE DEFENDANT, CHARLES A. ANDERSON, PRAYED TO HAVE THE VERDICT OF THE LOWER COURT VACATED ON THE GROUNDS THAT THE CHARGES WERE IMPROPERLY DRAWN, THAT THE WITNESSES BORE FALSE TESTIMONY AND WERE OF QUESTIONABLE CHARACTER, AND THAT THE EVIDENCE DID NOT SUPPORT THE VERDICT. IN THE EVENT THAT THIS PRAYER WAS DENIED, THE COURT WAS FURTHER PETITIONED FOR LENIENCY AND A REDUCTION OF THE SENTENCE IMPOSED BY THE LOWER COURT BECAUSE OF MITIGATING CIRCUMSTANCES. THE COURT CONCURS WITH THE DEFENDANT'S PLEA THAT THE EVIDENCE IS CONCLUSIVE THAT SRI HAS NOT AND IS NOT BEING OPERATED AS A BUSINESS. HOWEVER, THIS IS NOT PERTINENT. THE CHARGE STATED THAT THE DEFENDANT HAD "ATTEMPTED TO OPERATE SAID INSTITUTE AS IF IT WERE A BUSINESS." HERE THE COURT FINDS FOR THE COUNTY. IF |
