Show 2. THE DEFENDANT COULD HAVE, HE WOULD HAVE. LACK OF ABILITY IS NO EXCUSE BEFORE THE LAW. AS TO THE SECOND CHARGE OF AIDING AND ABETTING SEVERANCE FROM STANFORD, THE DEFENDANT CITES THE "NO FAULT DIVORCE LAWS" AS JUSTIFICATION FOR HIS ACTIONS. HOWEVER, THE COURT POINTS OUT THAT SUCH LAWS WERE NOT IN EFFECT WHEN SRI AND STANFORD SEPARATED. IF THEY HAD BEEN, THE ALIMONY MIGHT WELL HAVE BEEN LESS. THIS IS ONE OF THE FEW INCIDENTS THAT THE DEFENDANT CAN CITE WHERE HE WAS AHEAD OF HIS TIME. AS TO THE OTHER CHARGES THE COURT FINDS ITSELF IN SYMPATHY WITH THE DEFENDANT. THESE CHARGES PRESUME THAT AS PRESIDENT AND CHIEF EXECUTIVE OF SRI THE DEFENDANT WAS IN COMPLETE COMMAND WITH A FIRM HAND ON THE TILLER, THAT HE COULD AT HIS WHIM GRANT OR WITHHOLD FAVORS AND SUCH INALIENABLE RIGHTS AS FIRST-CLASS AIR |
